Lumisque Inc. (“Lumisque,” “Shop Lumisque,” “CO2Lift,” “we,” “us,” or “our”) respects your privacy and is committed to protecting the personal information entrusted to us.

This Privacy Policy and Notice explains how Lumisque Inc. collects, uses, discloses, retains, and protects personal information when you visit, browse, create an account with, make a purchase from, subscribe through, communicate with, or otherwise interact with the Shop Lumisque website, online store, customer accounts, checkout, subscription services, advertisements, and related services, collectively referred to as the “Site” or “Services.”

Lumisque Inc. is a Florida corporation and is the home of CO2Lift®. This Privacy Policy applies to individuals located in the United States and Canada. Certain portions of this Privacy Policy provide additional information for residents of jurisdictions with specific privacy laws.

By visiting or using the Site, you acknowledge that you have read and understood this Privacy Policy. This Privacy Policy does not create contractual rights or obligations beyond those required by applicable law.

1. WHO WE ARE

The Site is owned and operated by Lumisque Inc., located at 304 Indian Trace, Suite 276, Weston, Florida 33326, United States.

2. NOTICE AT COLLECTION

Depending on how you interact with the Site, we may collect identifiers and contact information, customer account information, commercial and transaction information, limited payment information, Internet and device activity, customer-service communications, marketing preferences, and limited inferences regarding product interests.

Identifiers and Contact Information

We may collect your first and last name, billing address, shipping address, email address, telephone number, customer account identifier, Internet Protocol address, device identifiers, cookie identifiers, and other similar identifiers.

We use this information to create and administer customer accounts, process and deliver orders, communicate with customers, provide customer service, prevent fraud, maintain the security of the Site, and comply with applicable legal obligations.

Customer Account Information

If you create an account, we may collect and maintain information associated with that account, including your login credentials, saved addresses, order history, subscription status, account preferences, communication preferences, and customer-service history.

Customer account credentials may be administered through Shopify. Passwords and similar authentication information are used to provide and secure your account and are not used for advertising purposes.

Commercial and Transaction Information

When you browse or purchase products, we may collect information concerning the products you viewed, placed in a shopping cart, purchased, returned, exchanged, or canceled. We may also collect order dates, order values, promotional or discount code usage, delivery selections, purchase status, payment status, and customer preferences reflected by your shopping activity.

If you enroll in a subscription, we may also collect your subscription selections, delivery frequency, renewal dates, pauses, skipped deliveries, modifications, cancellations, and related transaction history.

We use commercial and transaction information to process purchases, provide subscriptions, fulfill orders, administer returns and refunds, improve our product offerings, analyze customer activity, and personalize the shopping experience.

Payment and Financial Transaction Information

When you make a purchase, payment information is collected and processed through Shopify Payments, Shop Pay, and other payment service providers made available through Shopify.

Lumisque Inc. does not directly store your complete credit or debit card number or card security code. We may receive limited payment-related information, including the payment status, payment method, billing name and address, card brand, last four digits of the payment card, transaction identifier, and fraud or risk indicators.

Payment processors may independently collect and process additional information in accordance with their own privacy notices, contractual obligations, and legal requirements.

Internet, Device, and Electronic Activity Information

When you visit or interact with the Site, we and our technology providers may automatically collect information concerning your Internet connection, browser, device, operating system, approximate location, referring website, and Site activity.

This information may include your Internet Protocol address, browser type, device type, operating system, general location derived from an Internet Protocol address, referring website or advertising source, pages viewed, products viewed, links clicked, searches performed, cart activity, checkout activity, purchase events, visit dates and times, time spent on the Site, cookie identifiers, pixel identifiers, advertising interactions, and website-performance information.

We use this information to operate and secure the Site, remember customer preferences, understand how the Site is used, diagnose technical issues, measure advertising effectiveness, prevent fraud, improve products and services, and provide relevant advertising where permitted by law.

Communications and Customer-Service Information

When you communicate with us, we may collect your name, contact information, order details, and the contents of your communication. This may include customer-service requests, feedback, product questions, complaints, return requests, refund requests, and other information you voluntarily provide.

Please do not send highly sensitive personal, medical, financial, or government identification information through general customer-service forms unless the information is reasonably necessary for us to address your request.

Marketing and Preference Information

If you subscribe to marketing communications or otherwise provide consent, we may collect and maintain your email marketing preferences, text-message marketing preferences, cookie consent choices, advertising preferences, records of consent, and unsubscribe requests.

You are not required to consent to promotional communications as a condition of purchasing products from us.

Inferences

We may draw limited inferences from your shopping and Site activity, such as your likely product interests or advertising preferences. We may use these inferences to improve merchandising, customer experience, analytics, and advertising.

Sensitive Personal Information

We do not use or disclose sensitive personal information for the purpose of inferring characteristics about customers.

Account login credentials and payment-account information may be considered sensitive personal information under certain laws. We use these categories only as reasonably necessary to provide customer accounts, process transactions, secure the Site, prevent fraud, and comply with applicable law.

We do not sell sensitive personal information or share sensitive personal information for cross-context behavioral advertising.

3. SOURCES OF PERSONAL INFORMATION

We collect personal information directly from you when you visit or browse the Site, create or update an account, place an order, enroll in a subscription, update or cancel a subscription, contact customer service, request a return or refund, participate in a promotion, subscribe to marketing communications, submit a privacy request, or otherwise voluntarily provide information.

We also collect information automatically from your browser or device through cookies, pixels, tags, local storage, log files, analytics technologies, advertising technologies, and similar tracking tools.

Because the Site is hosted and operated through Shopify, we may receive information from Shopify concerning customer accounts, orders, checkout activity, payments, shipping, fraud analysis, Shop Pay, Site interactions, customer privacy preferences, and other Shopify services used by the Site.

If you purchase a subscription, we may receive information from Recharge concerning your subscription enrollment, selected products, delivery frequency, renewal dates, subscription payment status, modifications, pauses, skipped deliveries, cancellations, customer account, and transaction history.

We may receive information from analytics and advertising providers, including Google and Meta, concerning website visits, advertising impressions, advertising interactions, conversions, campaign performance, audience activity, device information, browser information, approximate location, and other analytics or advertising measurements.

We may also receive information from service providers and business partners that assist us with payment processing, fraud prevention, shipping, delivery, customer service, website hosting, analytics, advertising, accounting, legal compliance, and other business operations.

4. HOW WE USE PERSONAL INFORMATION

We use personal information to provide, operate, maintain, and improve the Site and Services.

This includes displaying products, maintaining customer accounts, providing checkout services, processing payments, confirming transactions, fulfilling and shipping orders, providing delivery updates, processing returns and refunds, administering subscriptions, responding to customer inquiries, and providing customer support.

We may use personal information to communicate with you regarding order confirmations, shipping and delivery notices, subscription renewals, subscription changes, payment issues, account activity, product or safety notices, customer-service matters, policy updates, and promotional communications when permitted by law.

We may use personal information to personalize and improve the Site by remembering preferences, maintaining cart activity, recommending products, improving navigation, understanding customer interests, evaluating Site performance, developing products and services, improving customer service, and diagnosing technical issues.

We may use personal information and aggregated information for analytics and measurement purposes. This may include understanding how customers find and use the Site, measuring traffic and engagement, analyzing product performance, evaluating advertising effectiveness, measuring marketing campaigns, creating business reports, and improving our operations.

Where permitted by law, we may use personal information to display advertisements, create advertising audiences, retarget individuals who previously visited the Site, measure advertising performance, limit repeated advertisements, and determine whether an advertisement resulted in a visit, checkout, or purchase.

Certain advertising activities may be considered targeted advertising, cross-context behavioral advertising, sharing, or a sale under certain state privacy laws, even when no money is exchanged.

We may also use personal information to authenticate accounts, maintain Site security, detect and prevent fraud, investigate suspicious activity, enforce our policies, protect our legal rights, protect customers and the public, comply with tax and accounting obligations, respond to lawful government or court requests, and establish, exercise, or defend legal claims.

Personal information may also be used for internal business purposes, including accounting, auditing, recordkeeping, inventory management, business planning, quality control, corporate governance, legal compliance, vendor management, and business continuity.

5. SHOPIFY, SHOPIFY PAYMENTS, AND SHOP PAY

The Site is hosted through Shopify. Shopify provides the e-commerce platform that allows us to display products, administer customer accounts, process orders, manage checkout, and provide related online-store services.

When you visit the Site or make a purchase, Shopify may process personal information on our behalf. Shopify may also process personal information for its own purposes, including providing, securing, personalizing, and improving Shopify services such as Shop, Shop Pay, fraud prevention, and other consumer services.

When you use Shop Pay or another Shopify consumer service, Shopify’s processing of your personal information is also governed by Shopify’s applicable privacy policies and privacy controls.

Payment information entered during checkout is collected and processed through Shopify Payments, Shop Pay, or another authorized payment processor. Lumisque Inc. does not directly store complete payment-card numbers or card security codes.

You may review Shopify’s privacy practices through the Shopify Consumer Privacy Policy and Shopify Privacy Portal.

6. RECHARGE SUBSCRIPTIONS

We use Recharge to administer recurring-product subscriptions.

When you enroll in a subscription, Recharge may process your name, email address, billing information, shipping information, selected subscription products, order history, delivery schedule, renewal frequency, subscription status, payment token, limited payment details, and information concerning subscription changes, pauses, skipped deliveries, and cancellations.

Recharge generally processes this information on behalf of Lumisque Inc. to provide subscription services. Recharge may also process certain information for its own operational, legal, security, and compliance purposes, as described in its privacy policy.

Your subscription payment method may be securely tokenized by Shopify, Recharge, or their payment-processing partners. Lumisque Inc. does not directly store your complete payment-card number.

7. COOKIES AND TRACKING TECHNOLOGIES

We and our service providers use cookies, pixels, tags, local storage, log files, and similar technologies.

Cookies are small data files that may be stored on your browser or device. Some cookies are required for the Site to operate, while others support optional functionality, analytics, personalization, and advertising.

Strictly necessary cookies are used to operate and secure the Site, enable account login, remember cart contents, process checkout, complete transactions, prevent fraud, and remember privacy preferences. Because these cookies are necessary to provide the Site and Services, they generally cannot be disabled through our cookie-preference tools.

Functional cookies may be used to remember customer preferences, improve Site functionality, maintain selected settings, and support optional features. Disabling functional cookies may affect the availability or performance of certain features.

Analytics and performance cookies help us understand how visitors use the Site, which pages and products are viewed, how long visitors remain on the Site, whether technical errors occur, and which marketing sources result in visits or purchases.

Advertising cookies and pixels may be used to measure advertising, attribute purchases to advertising campaigns, build advertising audiences, display relevant advertising, retarget prior Site visitors, and limit repeated advertisements.

Where required by law, we will request consent before using non-essential cookies or tracking technologies.

You may manage non-essential cookie preferences through the cookie banner or Cookie Preferences link available on the Site. You may also configure your browser to block or delete cookies, although blocking certain cookies may prevent portions of the Site from operating properly.

Cookie preferences are generally specific to the browser and device used. You may need to update your preferences separately on each browser and device.

8. GOOGLE ANALYTICS

We use Google Analytics to understand how visitors interact with the Site.

Google Analytics may collect device and browser information, approximate location, session activity, pages viewed, products viewed, referral source, Site interactions, conversion events, purchase events, and cookie or device identifiers.

Google Analytics uses cookies and similar technologies to provide aggregated reports and Site-usage statistics.

Depending on our Google Analytics configuration, information may also be used for advertising measurement, audience creation, or remarketing. Where required, these features will be subject to your consent or privacy preferences.

You may control analytics cookies through the Site’s cookie-preference tools. Google may also provide independent privacy controls, advertising settings, and a Google Analytics opt-out browser tool.

Google processes personal information in accordance with its own privacy policies and contractual terms.

9. META PIXEL AND META ADVERTISING

We use the Meta Pixel and related Meta business tools to measure advertising performance and understand actions taken after an individual views or interacts with an advertisement on Facebook, Instagram, or another Meta service.

The Meta Pixel may collect or receive information concerning Site visits, pages viewed, products viewed, cart activity, checkout activity, purchases, device and browser information, Internet Protocol address, cookie identifiers, advertising interactions, transaction value, and other advertising events.

We may use this information to measure campaign performance, attribute purchases to advertisements, create advertising audiences, retarget previous Site visitors, and improve advertising.

Meta may combine information received through its business tools with information associated with a Meta account, subject to Meta’s privacy policies and account settings.

Where required by law, the Meta Pixel and other non-essential advertising technologies will be controlled through the Site’s cookie-consent and privacy-choice mechanisms.

10. HOW WE DISCLOSE PERSONAL INFORMATION

We may disclose personal information to Shopify and other e-commerce or technology providers that host, operate, maintain, secure, or support the Site.

We may disclose transaction information to Shopify Payments, Shop Pay, banks, card networks, payment processors, and fraud-prevention providers for the purpose of processing payments and protecting transactions.

We may disclose subscription information to Recharge and related providers that administer recurring orders, billing schedules, delivery schedules, and customer subscription accounts.

We may disclose names, addresses, contact information, and order details to warehouses, fulfillment providers, shipping carriers, and delivery services for the purpose of fulfilling and delivering purchases.

We may disclose Site, device, cookie, and activity information to analytics providers such as Google to measure and understand Site usage.

We may disclose identifiers, commercial information, and Internet or electronic activity information to advertising providers such as Meta and, where enabled, Google or Shopify advertising services. These disclosures may be considered targeted advertising, sharing, or a sale under certain privacy laws.

We may disclose information to attorneys, accountants, auditors, insurers, consultants, and other professional advisers where reasonably necessary for business, legal, or compliance purposes.

We may disclose personal information when reasonably necessary to comply with applicable law, respond to a subpoena or court order, cooperate with regulators or law enforcement, protect our rights, protect customers or the public, investigate fraud or unlawful activity, or enforce our agreements and policies.

Personal information may also be disclosed or transferred as part of a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or other corporate transaction. Any recipient will be subject to applicable legal obligations concerning the information received.

We may also disclose personal information at your direction or with your consent.

11. SALE, SHARING, AND TARGETED ADVERTISING

Lumisque Inc. does not sell personal information in exchange for monetary payment.

However, our use of advertising and analytics technologies may involve disclosing identifiers, commercial information, Internet activity, and electronic activity to advertising partners. Under certain U.S. state privacy laws, these activities may be considered a sale of personal information, sharing for cross-context behavioral advertising, or targeted advertising.

The categories of information potentially disclosed for these purposes may include online identifiers, cookie identifiers, Internet Protocol addresses, device information, Site activity, product-viewing activity, cart activity, purchase and conversion events, approximate location, advertising interactions, and inferences regarding product interests.

The recipients of this information may include Meta, Google, Shopify where relevant services are enabled, and related advertising or analytics providers.

We do not knowingly sell or share personal information belonging to individuals under sixteen years of age.

You may opt out of sale, sharing, or targeted advertising by using the Your Privacy Choices, Data Sharing Opt-Out, or similar privacy link available in the Site footer. You may also manage advertising cookies through the Site’s cookie-preference tools.

12. GLOBAL PRIVACY CONTROL AND BROWSER SIGNALS

Certain browsers and browser extensions support privacy preference signals, including Global Privacy Control.

Where required by applicable law and where the signal can reasonably be associated with your browser or device, we will treat a recognized Global Privacy Control signal as a request to opt out of sale, sharing, or targeted advertising.

Because these signals are generally browser- and device-specific, the preference may apply only to the browser or device from which the signal is received.

There is not currently a universally accepted standard for all Do Not Track signals. We may not respond to older or unsupported Do Not Track signals, but we honor legally recognized opt-out preference signals where required.

13. DEIDENTIFIED AND AGGREGATED INFORMATION

We may create or use aggregated, statistical, or deidentified information that cannot reasonably be used to identify you.

We may use and disclose this information for lawful purposes, including analytics, research, business planning, product development, and reporting.

Where required by law, we will maintain deidentified information in deidentified form and will not attempt to reidentify it except as permitted to determine whether our deidentification processes are reasonable and effective.

14. DATA RETENTION

We retain personal information only for as long as reasonably necessary for the purposes described in this Privacy Policy, including providing the Services, maintaining business and transaction records, complying with legal obligations, resolving disputes, preventing fraud, and enforcing agreements.

Retention periods vary depending on the nature of the information and the reason it was collected.

Customer account information may be retained while an account remains active and for a reasonable period after closure. Order, payment, tax, accounting, and transaction records may be retained for the period required by applicable tax, accounting, consumer-protection, and recordkeeping laws.

Subscription information may be retained for the duration of the subscription and for a reasonable period afterward for billing, customer-service, legal, and accounting purposes.

Customer-service communications may be retained for as long as reasonably necessary to resolve the matter, maintain appropriate records, and protect legal rights.

Marketing preferences and unsubscribe records may be retained to ensure that we continue to honor your choices.

Cookie and analytics information may be retained according to the applicable cookie duration, provider settings, and business purpose. Fraud-prevention and security records may be retained as reasonably necessary to protect the Site, customers, and business.

When personal information is no longer reasonably necessary, we may delete, anonymize, or securely dispose of it, subject to legal and technical limitations.

15. DATA SECURITY

We use reasonable administrative, technical, organizational, and physical safeguards designed to protect personal information against unauthorized access, destruction, loss, alteration, misuse, or disclosure.

These safeguards may include access restrictions, authentication controls, encryption in transit, secure payment processing, vendor security requirements, fraud-monitoring tools, confidentiality obligations, security monitoring, and appropriate record-retention and disposal procedures.

No website, network, database, or method of electronic transmission is completely secure. We cannot guarantee absolute security.

You are responsible for maintaining the confidentiality of your account credentials and for notifying us if you believe your account or personal information has been compromised.

If we experience a security incident involving personal information, we will investigate and provide notifications to affected individuals, regulators, or other parties where required by applicable law.

16. MARKETING COMMUNICATIONS

If you elect to receive marketing emails, you may unsubscribe at any time by using the unsubscribe link contained in the message.

If you elect to receive promotional text messages, you may opt out by replying STOP or following the instructions included in the message.

Opting out of promotional communications will not prevent us from sending non-promotional communications, including order confirmations, shipping notices, subscription notices, account-security notices, customer-service responses, and legally required communications.

We may retain your contact information on a suppression list to ensure that we continue to honor your opt-out request.

17. YOUR PRIVACY RIGHTS

Depending on your state, province, or territory of residence and subject to applicable exceptions, you may have the right to confirm whether we process your personal information, access personal information maintained about you, request a copy of personal information, correct inaccurate information, delete personal information, obtain information in a portable format, withdraw consent, opt out of sale or sharing, opt out of targeted advertising, opt out of certain profiling activities, limit certain uses of sensitive personal information, appeal a privacy decision, and receive equal service without unlawful discrimination for exercising privacy rights.

These rights are not absolute. Applicable law may permit or require us to retain or continue processing information for purposes such as completing transactions, preventing fraud, complying with legal obligations, maintaining records, protecting legal rights, or exercising legally protected rights.

Please use the subject line “Privacy Request” and provide your full name, the email address associated with your account or order, your state, province, or territory of residence, the type of request you are making, and information reasonably necessary to locate your records.

Please do not send a copy of government identification unless we specifically request it as reasonably necessary to verify your identity.

Verification

We may need to verify your identity before completing a privacy request. Verification measures will be proportionate to the nature of the request and the sensitivity of the information involved.

We may verify a request by confirming control of an email address, requesting order information, requesting account information, asking reasonable verification questions, or using another legally permitted verification method.

If we cannot reasonably verify your identity, we may be unable to complete the request.

Authorized Agents

Where permitted by law, you may appoint an authorized agent to submit a request on your behalf.

We may require written authorization, verification of the agent’s identity, direct confirmation from you, or evidence of a legally valid power of attorney.

Appeals

If we deny a privacy request and applicable law provides a right to appeal, you may appeal by emailing support@co2lift.com with the subject line “Privacy Request Appeal.”

Please include the original request and any additional information you believe we should consider.

Non-Discrimination

We will not unlawfully discriminate against you for exercising a privacy right.

We may offer different prices, products, services, or benefits where reasonably related to the value of information and permitted by applicable law. We will provide any legally required notice before offering a program that constitutes a financial incentive under applicable privacy law.

18. ADDITIONAL DISCLOSURES FOR U.S. RESIDENTS

Various U.S. states have enacted comprehensive consumer privacy laws. Whether a specific law applies depends on factors such as your residency, the type and volume of information processed, and the applicable statutory thresholds.

During the preceding twelve months, we may have collected identifiers, customer-record information, commercial information, Internet or electronic activity, approximate geolocation, account login information, limited payment information, transaction information, inferences concerning product interests, and customer-service communications.

We may have disclosed these categories for business purposes to Shopify, e-commerce providers, payment processors, Recharge, fulfillment providers, shipping carriers, customer-service providers, fraud-prevention providers, analytics providers, advertising providers, professional advisers, and government or legal authorities where required.

We have not sold personal information for money. However, our use of Meta Pixel, advertising cookies, analytics tools, and related technologies may be considered a sale, sharing, or targeted advertising under certain laws.

The categories potentially involved may include identifiers, online identifiers, Internet or electronic activity, commercial information, approximate location, advertising interactions, and inferences concerning product interests. The recipients may include Meta, Google, Shopify where relevant features are enabled, and related advertising or analytics providers.

We do not sell sensitive personal information, share sensitive personal information for cross-context behavioral advertising, or use sensitive personal information to infer characteristics about an individual.

We do not currently offer a financial incentive in exchange for personal information as that term is defined under California law. If we introduce a program that constitutes a legally recognized financial incentive, we will provide a separate notice describing its material terms.

Subject to legal applicability and exceptions, California residents may have the right to know the categories and specific pieces of personal information collected, know the sources and purposes of collection, know the categories of recipients, request deletion, request correction, opt out of sale or sharing, limit certain uses of sensitive personal information, and receive equal treatment for exercising privacy rights.

California residents may exercise sale and sharing opt-out rights through the Site’s Your Privacy Choices or data-sharing opt-out link.

Residents of Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, Virginia, and other states with applicable consumer privacy laws may have similar access, correction, deletion, portability, opt-out, consent, and appeal rights, subject to each law’s scope, effective date, thresholds, and exceptions.

19. ADDITIONAL DISCLOSURES FOR CANADIAN CUSTOMERS

For Canadian customers, Lumisque Inc. handles personal information in accordance with applicable Canadian privacy law, which may include the Personal Information Protection and Electronic Documents Act and applicable provincial private-sector privacy laws.

Lumisque Inc. is responsible for personal information under its control and has designated a Privacy Officer to address privacy questions and requests.

We identify the purposes for collecting personal information at or before the time the information is collected, including through this Privacy Policy, checkout notices, subscription disclosures, cookie notices, and other appropriate communications.

We obtain consent where required by Canadian law. The appropriate form of consent may depend on the sensitivity of the information, the reasonable expectations of the individual, the purpose of processing, and the method of collection.

Where required, we request consent before using non-essential cookies, targeted advertising technologies, or personal information for a materially new purpose.

You may withdraw consent, subject to reasonable notice and applicable legal or contractual limitations. Withdrawal of consent may affect our ability to provide certain optional features or services.

We limit the collection, use, disclosure, and retention of personal information to purposes that a reasonable person would consider appropriate in the circumstances. We retain personal information only for as long as reasonably necessary for identified purposes and legal obligations.

We take reasonable steps to keep personal information accurate, complete, and current where necessary for the purposes for which it is used. You may request correction of inaccurate or incomplete personal information.

We use safeguards that are appropriate to the sensitivity of the personal information involved.

Subject to legal exceptions, Canadian customers may request confirmation of whether we hold personal information about them, access to their personal information, information regarding how the information has been used, information concerning recipients of the information, and correction of inaccurate or incomplete information.

We may request information reasonably necessary to verify your identity before completing an access or correction request.

Canadian customers may direct questions or complaints to our Privacy Officer. If you are not satisfied with our response, you may have the right to contact the Office of the Privacy Commissioner of Canada or the applicable provincial privacy regulator.
